 Bernard Silver, et al v. Del Webb Communities Inc.          Clark County District Court Case No. 437325

  On July 17, 2001, this firm filed an action for defective plumbing installation against Del Webb Communities, Inc., on behalf of named Plaintiffs Bernard Silver, Stan Bjonerud, Fred W. Schaefer, Frank T. Beers II, and Lou Soreano. Members of the class consisted of all owners of record of homes in Sun City Summerlin with un-sleeved, under-slab copper plumbing constructed and completed by Del Webb Communities, Inc., on or subsequent to July 17, 1991.      Before and during the pendency of the lawsuit, many homes experienced leaks in their under-slab hot water copper pipes.  For a list of homes that are known to have under-slab leaks and full repairs please see below. KINDLY NOTE THAT THIS LIST IS FOR INFORMATIONAL PURPOSES ONLY. THIS OFFICE DID NOT TRACK LEAKS THAT MAY HAVE OCCURRED AFTER THE CASE WAS SETTLED AND NOT ALL LEAKS MAY HAVE BEEN REPORTED TO THIS OFFICE PRIOR TO SETTLEMENT. ANY HOME THAT RECEIVED A FULL RE-PIPE REPAIR DID NOT RECEIVE A SETTLEMENT CHECK.

     On August 24, 2004, Judge Nancy Saitta of Clark County District Court granted final settlement approval in this matter.  The settlement provided that each member of the class that had not yet received full repairs by having it re-routed overhead at Del Webb's expense, received a settlement check in the amount of $5,000 to make repairs.  These settlement checks were disbursed in October of 2004.  To view a copy of the Owners who received a settlement please see below. KINDLY NOTE THAT THIS OFFICE DID NOT TRACK POST SETTLEMENT REPAIRS.  THE RECOMMENDED REPAIR WAS TO ABANDON THE UNDER-SLAB HOT WATER LINE AND RE-ROUTE IT OVERHEAD WITH A PEX SYSTEM.  iNSPECTORS SHOULD LOOK IN THE ATTIC FOR THE PRESENCE OF PEX PIPE TO DETERMINE IF REPAIRS WERE MADE.
